Opportunity & Risk

Every activity. Every age.

California offers the opportunity to participate in virtually every type of recreational and sporting experience, at virtually any age — from traditional experiences to modern ones. With opportunity comes risk.

Traditional Experiences

The classics

Baseball, softball, football, basketball, track and running, skiing, and other traditional sports and recreational activities.

Modern Experiences

The fast-moving fields

Surfing, skateboarding, off-roading, mountain biking, ATV riding, scuba diving, and other modern recreational pursuits.

Understanding the Risk

From bumps and bruises to catastrophic harm.

Risk in recreational and sports activities can range from insignificant bumps and bruises to serious, life-altering injury.

Head Trauma
Back, Neck & Spinal Cord Injuries
Ligament & Muscle Tears
Bone & Joint Injuries
The Legal Standard

Assumed risk vs. unreasonable risk.

The risks of some injuries are considered "assumed" by the participant in the recreational or sports activity. Other injuries, however, may give rise to liability under California law when the risks inherent in the activity are unreasonably increased by the acts of another. (See, e.g., Distefano v. Forester (2001) 85 Cal.App.4th 1249.)

Wilcox Dunakin Chrisopoulos, LLP has the experience and legal knowledge required to provide guidance and representation when these questions arise.
